Terms of Service

By accessing or using AI Photo Prompt (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

AI Photo Prompt provides a free prompt builder for AI image generation tools. The free prompt builder requires no account. Paid credits unlock AI image generation features powered by third-party APIs (Replicate).

• Credits are purchased through Paddle, our Merchant of Record. All payment processing, tax collection, and refund obligations are handled by Paddle.
• Credits are non-transferable and non-refundable except as required by applicable law or Paddle's refund policy.
• Credits are deducted only after a successful image generation. If generation fails due to a service error on our end, credits are restored.
• Credits do not expire but may be forfeited if your account is terminated for policy violations.

You agree not to use the Service to:

• Generate content that is sexually explicit, violent, or harmful
• Create non-consensual synthetic media (deepfakes) of real individuals
• Infringe on third-party intellectual property rights
• Violate any applicable laws or regulations
• Attempt to circumvent content moderation systems
• Use automated scripts to abuse free-tier access

We use automated content moderation on all prompts and generated images. Violations may result in account termination without refund.

You retain ownership of images you generate using the Service, subject to the terms of the underlying AI model provider (Replicate / Flux). We claim no ownership over your generated images.

By using the Service, you grant us a limited licence to store and display your generated images for the purpose of providing the Service (e.g. displaying them back to you) and for abuse detection.

The prompt templates, UI, design system, and all other original content of AI Photo Prompt are owned by us and protected by copyright. You may not scrape, copy, or redistribute them without permission.

The Service is provided “as is” without warranties of any kind. We do not guarantee that generated prompts or images will meet your specific requirements or be fit for commercial use. Quality of output depends on third-party AI models outside our control.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 30 days preceding the claim.

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice. You may stop using the Service at any time.

These Terms are governed by the laws of the jurisdiction in which we are incorporated. Disputes shall be resolved through binding arbitration where permitted by law.

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. Material changes will be announced on the site.
